Empire Electric Association, Inc. Terms of Service Membership Agreement
 

  1. The Applicant shall deposit with Empire Electric Association, Inc. (EEA) such sums as may be required from time to time in accordance with EEA’s then current Bylaws, policies and procedures and will be held by EEA as a guarantee and security deposit. Applicant agrees that EEA’s interest in the deposit is a secured interest for all purposes under federal and state law, including, but not limited to, federal bankruptcy laws and rules. The deposit shall be applied to any unpaid amount due EEA at the time of discontinuance of service, and the balance, if any, shall be returned to the Member. The amount of the deposit shall be determined by EEA in an amount necessary to guarantee payment of service rendered to the Member in accordance with EAA's Bylaws, policies and operating procedures. Any deposit held by EEA shall secure payment not only of the above-listed account, but also for any other account of the Applicant.
  2. For Residential service accounts: EEA charges all new residential service accounts a $150.00 deposit for dual fuel services and $375.00 for all electric services. “Dual fuel” means primary source of heat is natural gas or propane and “all electric" means primary source of heat is electric. Existing EEA members that open an additional residential service and have a credit rating of B or less as determined by EEA will be required to pay the appropriate deposit to open the additional account.
  3. For Commercial Services: EEA charges all new commercial services a deposit equal to three (3) times the average monthly bill for the service. Existing EEA members must pay a deposit for each additional new commercial service account they open regardless of credit rating.
  4. The Applicant will purchase from EEA all electric service used on the premises specified in his or her application for membership, unless and except such energy is generated from the member’s own assets and the board of trustees has waived in writing such requirement.  The applicant will pay for this service, on a monthly basis or such other basis as should be chosen or deemed necessary, at rates to be determined from time to time in accordance with the applicable Bylaws and policies of EEA. EEA may limit the amount of electric energy to be furnished for industrial purposes.
  5. Services billed to Applicant are due when rendered, and service may be discontinued if payment is not received by the date listed in the billing notice. Applicant acknowledges receipt of EEA’s Billing, Collection and Deposit Practices as set forth in EEA. Customer Packet and Policy Bulletins. Applicant agrees to stay apprised of any changes or additions to such practices in accordance with notices from Empire Electric Association, Inc. that may be mailed to Applicant, published in local news media, or posted on EEA’s website.
  6. Applicant shall be deemed to have accepted all of the terms and conditions hereof by any one or more of the following means: by signing this application; by accepting and using services provided by EEA; if by telephone or by other electronic means, by providing EEA with customer information requested by EEA to establish an account; or by completing the application process via this website.
